I have a very strong feeling that we are going to get stuck having to sign a one year lease, and that we will have less time than we need to find a place that we can be happy in, and will therefore be stuck in a place that is frustrating for an entire year. I sincerely hope this doesn't happen, and am trying not to make it happen.

Date: 2008-07-21 08:14 pm (UTC)If they do find a new tenant, you're off the hook. I don't know what happens if, hypothetically, they find a tenant who subsequently leaves.
You don't necessarily have to give up your security deposit - if the apartment is vacant for, say, two months after you break the lease and you pay rent for those two months, you should get your deposit back. They can deduct from it to cover unpaid rent or damages, but not just because you broke the lease if you paid your rent obligations.
And for what little it's worth, as long as you're paying rent you have the right to enter and use the premises. This would not be much consolation in those circumstances, of course.
It's a bad situation to be in. It might work out OK, but could cost you a lot of money if it doesn't.

Date: 2008-07-21 08:02 pm (UTC)If they require you to pay the balance of the rent, then you probably have the option of subletting to someone else to make up for it. I do think most landlords are pretty reasonable if you give them a lot of notice (30+ days, preferably more), are in general a good tenant, and offer to help find new tenants for the apartment.
