Maven Realty has no apartments listed that are at-will, and apparently, "nothing is on a six month lease."

I have a very strong feeling that we are going to get stuck having to sign a one year lease, and that we will have less time than we need to find a place that we can be happy in, and will therefore be stuck in a place that is frustrating for an entire year. I sincerely hope this doesn't happen, and am trying not to make it happen.

I wonder if checking out localities you like for "For Rent By Owner" signs would help. I've seen a few in my area. Yeh, it's along shot. Butyou know that SOMEWHERE out there is what you need: it's a matter of connecting.

What are you looking for? Post the description so your friends can take turns keeping an eye out for you.

i expect to sign a lease, and will break it if necessary. i don't know what's incurred by breaking a lease, but it's an option for me since it seems about the only way to get a place is to sign the paper.

i hope to have landlords with whom i can discuss breaking a lease. and i'll cross that bridge when i get to it.

maybe it's something to investigate? what would be the penalties, generally, or specifically depending on the lease form used? could you deal with those penalties?

not trying to give you more to do, but rather offer a suggestion. and no, i don't know if it's a worthwhile thing to check out or not. :)

I just did a bit of googling. It looks like being able to do it for a reason other than gross negligence on the landlord's part without having to continue paying rent and give up your security deposit requires a REALLY NICE and sympathetic landlord.

As I understand it, you're liable for the rent for whatever period the lease covers in which there's no one else renting it. The landlord has a duty to seek a new tenant, but as always is allowed to reject potential tenants. You can't necessarily sublet freely; most leases require the landlord to approve a sublettor.

If they do find a new tenant, you're off the hook. I don't know what happens if, hypothetically, they find a tenant who subsequently leaves.

You don't necessarily have to give up your security deposit - if the apartment is vacant for, say, two months after you break the lease and you pay rent for those two months, you should get your deposit back. They can deduct from it to cover unpaid rent or damages, but not just because you broke the lease if you paid your rent obligations.

And for what little it's worth, as long as you're paying rent you have the right to enter and use the premises. This would not be much consolation in those circumstances, of course.

It's a bad situation to be in. It might work out OK, but could cost you a lot of money if it doesn't.

I don't think breaking a lease can do anything to your credit. Or at least, I've never heard of it, and I'm sure people do it all the time (ask the LJ Genie, though).
If they require you to pay the balance of the rent, then you probably have the option of subletting to someone else to make up for it. I do think most landlords are pretty reasonable if you give them a lot of notice (30+ days, preferably more), are in general a good tenant, and offer to help find new tenants for the apartment.

Yeah, the paying the balance of the rent is what really worries me, since we will be BROKE from buying a home. Finding someone to sublet other than in the summer might be pretty tough.

Yes, but consider how long it takes to find and buy a home. It might be quick, but it sounds like it's already taken months; you may very well take the better part of a year to find something ideal, make any changes necessary, and move in.

Hrm. I do know someone who just moved out of a month-to-month in a pretty nice apartment, but I think it was a 1 bed. I'll see if she has the landlord's number, though.
